The judge found that the government's arguments for restricting marriage to one man and one woman "strains credulity" and that "irrational prejudice plainly never constitutes a legitimate government interest." The judge found DOMA to be unconstitutional on two counts. First, it violates the Equal Protection Clause of the Fifth Amendment. Second, it interferes with states rights as guaranteed in the Tenth Amendment—the Don't Tread on Me amendment.
